BOARD ACCOUNTABILITY

Board Accountability:

I bought my home as it currently is. When I wanted to change my split rail and privacy fence in my back yard to the IDENTICAL look but changing to nonflammable materials, the board rejected my proposal. Their issue is the wiring between and below the rails to prevent my (or previous) dogs from escaping. Focus: I wanted the EXACT SAME SET UP, simply switching flammable to FIRE PROOF MATERIALS. The CC&Rs speak specifically to supporting homeowners efforts to reducing fire risk. The split rail fence was mentioned specifically in my fire report from the city as a fire hazard and my request to change it is in total alignment with our CC&Rs.

The board told me that the screening was in violation of the CC&Rs. First, I asked them why they didn’t notify me or my realtor PRIOR to the close of escrow that there was a current violation. I would not have bought a house that didn’t have a backyard for my dog. That secure fence was a key component in my decision making. They told me that my realtor should have known. The realtor and I both had the CC&Rs that were provided by the association and which did not include specific fence details. Those details are only available through the homeowner portal which I did not have access to until I became a homeowner. Typical Catch 22.

I would also like to point out that the “For Sale” sign was out for months and that the HOA member who walks by my home daily (according to her) did not notify the realtor or previous homeowners that there was a pending violation.

I also asked the board WHEN that fencing was installed and IF they had notified previous owners regarding its lack of compliance. They had NO IDEA how long it’d been there and had NO records of communicating with any previous owners related to ANY infraction on the property. They willfully ignored it until I wanted to improve my home.

My neighbors and seven other homes in a ¼ mile radius have the same fencing! I asked the board member who said that she walks by my property daily, WHY didn’t she notice the fencing in my and SEVEN other homes in the immediate vicinity? They are all clearly visible. I took pictures of all of the other fences and she claimed that they were not visible from the street. If I saw the fences, why couldn’t she? If she saw the fences, why wasn’t she proactive?

My position is simple:
1) If the board has IGNORED modifications that happened decades ago – Grandfather them in! For ALL of us.
2) ANY modifications that IMPROVE fire safety should be allowed.
3) Each board member has a DUTY inside and outside of board meetings to enforce the CC&Rs, rather than willfully ignoring any violations until

neighbors have to bring them to the board’s attention.
4) When a home is sold in our community, the FULL CC&Rs should be provided to the new homeowner.
